EU General Terms of Business
The following conditions apply for the European Union (EU). Shipments to other countries are
subject to special shipping terms.
§1 Prices
Prices are subject to alteration and depend on currency exchange rates and price increases of our
suppliers respectively. When ordering from our internet shop, you are given the relevant price. Our
customers are not bound to their order in case of price increase. All prices include value added tax.
There are shippping and packing costs for your order depending on the country. Orders which
exceed a certain invoice amount are free of shipment and packing charges for many countries. The
list of transportation costs
indicates the respective costs for your country. Please notice that
the amount of your order value reduces if you return CDs at the same time. In this case, we reserve
the right for us to charge the corresponding shipment costs.
§2 Cancelling rights according to the German law governing remote sales:
The following right does not come into effect in case of sealed goods (Audio recordings, video
recordings, software on all types of data carriers), if you open the sealed packaging or when you
damage it (unseal it). Special orders which are ordered by us especially for you cannot be cancelled
(this concerns all titles which are not in stock normally and which we order at your request. The
product information for each CD tells you about the availability of the article). As you cannot test
the CDs at home first, please make use of the audio files in our online shop.
You are not bound to your order if you return the goods within a period of two weeks after having
received the CDs. The cancellation does not require any explanation and it has to be made in written
form on a durable data carrier or by returning the goods. Please send back the goods in time in order

We will possibly refund the payments which have already been made after having received the
returned goods. You are obliged to return the goods - at our risk - if this has not already been made
when sending us your written cancellation. The shipment costs have to be paid by you in case of
returns, if the quantity of the order and the returned goods does not exceed the amount of EUR 40.
Please notice the following instructions for returns:
Danza y Movimiento MedienhandelsgesellschaftmbH is entitled to charge compensation if the
returns are damaged or if the goods have been used (§ 361a II German Civil Code).
Please use the proper amount of postage. Unfranked shipments will no be accepted. We cannot
accept any costs by courier services or other freight costs which exceed the usual postage. You have
to return complete packs or sets. Should the situation arrive, you will receive a credit note or another
form of compensation for the costs involved in the return.
§3 Payment and Shipment
You can choose from the following methods of payment:
A. Credit cards (Visa, Master/Eurocard, JCB, Amex, Diners):
B. Advance payment: Wait for the invoice. When the invoice arrives, transfer the money. As soon as
the invoice amount arrives, the CDs will be shipped. Please do not send any cheques! We cannot
accept liability in case of loss of cash or cheques sent to us.
C. Direct debit. If you own a German bank account, you can simply give us permission to debit the
account with the corresponding invoice amount.
D. Cash on delivery (only within Germany): You pay when you receive the package. Disadvantage:
the shipment costs are more expensive because the German Post charges extra for this service.
If the CDs are in stock, we can send you the CDs the following day (in case of variants A,C and D).
If your order arrives soon enough, we deliver the same day.
The shipment of articles which are not in stock depend on the correct and punctual delivery of our
suppliers. We cannot take full responsibiliy for any delay. The indicated delivery period is based on
not binding data of experience. A claim for compensation is only possible if the shipment has not
been carried out by us wilfully or because of carelessness on our part.
§3a
Please consider that you are also subject to the regulations of this contract when choosing variant B
(Advance payment). The stipulated period for the payment is 21 days. Afterwards we will send you a
reminder once and we will charge you EUR 5. If we should not receive any payment after the period
of another 14 days, the goods can be sold to other customers. The expense allowance will be EUR 25. You remain entitled to prove that we suffered no damage or only a marginal damage.
§3b
If the payment method C (Direct debit) fails and the amount withdrawn from your bank account is demanded back, we usually start a research and we try to contact you by telephone, email and/or by sending a letter. In addition to the bank fees we are charged with, this return of the money signifies a considerable extra effort for us. Please take into consideration:
We will charge the bank fees plus an extra fee of 30 Euro for the effort caused by the return of the money because of wrong bank or account details, because of uncovered or expired bank accounts or because your denial is not justified and has not been explained to us beforehand. You remain entitled to prove that we suffered no damage or only a marginal damage. If you do not agree with the bank transaction, please try to avoid costs and contact us in order to solve the problem before you demand the money back. Of course, we will not charge you any fees if we are responsible for the failure of the bank transaction.
§4 Back Orders
Please notice that we have to charge postage again if we send you articles which have not been in
stock at the time of your order. We will delay the shipment up to 10 days, if we expect the missing
articles to arrive within that period of time. If a CD ordered by you cannot be shipped within 12 weeks because of a delivery delay on the part of
our suppliers or because the article is cutout, your order will be cancelled. We will not inform you
about this automatic cancellation.
§5 Default of Payment
If your payments are overdue, we will charge an interest of 5% more than the basic interest rate
indicated by the Deutsche Bundesbank (www.bundesbank.de). You have the right to prove that no
or hardly any damage was caused by your default of payment.
§6 Reservation of Ownership
The delivered goods remain our property until they have been completely paid. In the meantime you
are obliged to handle them carefully and to inform us about damage immediately. In case of a default
of payment we are entitled to retreat from the contract and to demand the merchandise back. The
costs for the shipment in case of default of payment (after the stipulated cancellation time) are
chargeable to you and they have to be reimbursed by you if they have not been paid in the first place.
§7 Protection of Data
We store and use your data exclusively for dealing with the content of the contract (and, if needed,
for associated companies and for checking creditworthiness). Of course we will treat your data
confidentially.
§8 Place of Performance
The place of performance for all reciprocal services indicated in the contract including any claims to
reimbursement shall be Hamburg.
§9 Place of Jurisdiction
In business transactions with merchants and legal persons under public law, the place of jurisdiction
for all legal disputes arising from the contract, including actions on dishonoured bills or cheques,
shall be Hamburg. We are also entitled to sue customers whereever they are based.
§10 Applicable Laws
The laws of the Federal Republic of Germany applies for legal business or other legal relations with
Danza y Movimiento MedienhandelgesellschaftmbH. For contracts with an objective which cannot
be assigned to the customer’s professional or commercial activity, these laws shall only apply in as
far as protection provided by mandatory provisions of the law in the country in which the consumer
usually resides has not been revoked.
§11 Partial Invalidity
If some of the regulations of this contract or the general terms of business should be or should
become invalid, this does not affect the remaining regulations.

General Terms of Business for Countries outside the EU
The following conditions apply to the shipment to countries outside the European Union (EU).
Shipments to countries belonging to the EU are subject to special shipping terms.
